Darci Wilson filed a complaint alleging a physical therapist was negligent in providing her treatment and that Anonymous Defendant 1, an orthopedic physician group, is vicariously liable. Defendant 1 moved for summary judgment on grounds the therapist was not its employee, agent, or contractor. The St. Joseph Superior Court entered summary judgment for Defendant 1. The Court of Appeals affirmed, concluding Sword v. NKC Hospitals, Inc., 714 N.E.2d 142 (Ind. 1999), is “inapposite.” Wilson v Anonymous Defendant 1, No. 20A-CT-923 (Mar. 16, 2021), vacated. The Supreme Court has granted transfer and assumed jurisdiction over the appeal.
